Terms of Use, Online Ordering, Cancellation & Refund Policy

These Terms of Use, Online Ordering, Cancellation and Refund Policy (the “Terms”) govern your use of the Juici Canteen website, online ordering platform, mobile or tablet applications, and any other online service operated by or on behalf of Western Wholesale Inc. (“WWI”, “we”, “us” or “our”) through which customers may browse, order and/or pay for products offered by Juici Canteen (collectively, the “Services”).

By accessing or using the Services, placing an order, or making a purchase through the Services, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree with these Terms, please do not use the Services.

1. General Terms

1.1 These Terms apply to all customers who access or use the Juici Canteen Services, including customers who place orders for pickup or delivery where such service is offered.

1.2 WWI reserves the right to update or amend these Terms from time to time. Updated Terms will be made available through the Services and will apply to orders placed after the effective date of the updated Terms.

1.3 Nothing in these Terms is intended to exclude, restrict or remove any right or remedy that a consumer has under applicable laws of Barbados.

1.4 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

2. Eligibility and Use of the Services

2.1 You must provide accurate and complete information when placing an order.

2.2 Where an account is required, you are responsible for maintaining the confidentiality of your account information and for all activity carried out through your account.

2.3 You must not use the Services for any unlawful, fraudulent, abusive or unauthorized purpose.

2.4 You must not attempt to interfere with, disrupt, damage or gain unauthorized access to the Services or any systems supporting them.

2.5 WWI reserves the right to restrict or suspend access to the Services where there is reasonable evidence of fraud, misuse, abuse or violation of these Terms.

3. Products, Menus and Availability

3.1 Juici Canteen will make reasonable efforts to ensure that menu items, descriptions, prices and availability displayed through the Services are accurate and current.

3.2 Product images are provided for illustrative purposes, and the actual product may vary slightly in appearance.

3.3 Menu items are subject to availability. An item displayed online may become unavailable before an order is processed.

3.4 If an ordered item becomes unavailable, Juici Canteen may contact the customer to discuss an appropriate substitute or refund.

3.5 WWI reserves the right to modify, suspend or discontinue menu items, promotions or products without prior notice, subject to any order already accepted and paid for.

4. Prices and Taxes

4.1 All prices displayed through the Services will be stated in Barbados Dollars (BBD) unless otherwise indicated.

4.2 The applicable price, taxes and any delivery or other applicable charges will be displayed before the customer completes the order.

4.3 WWI will take reasonable steps to ensure that prices displayed online are accurate.

4.4 If an obvious pricing or system error occurs, WWI reserves the right to correct the error. Where an order has been placed at an incorrect price, WWI will contact the customer before fulfilling the order where reasonably practicable.

4.5 Where payment has already been made and the order cannot be fulfilled at the corrected price, the customer will be entitled to a refund of the amount paid.

5. Online Orders

5.1 Customers may place orders through the Juici Canteen online ordering platform during the operating hours displayed through the Services.

5.2 An order is considered submitted when the customer completes the checkout process.

5.3 Submission of an order does not necessarily constitute acceptance by Juici Canteen. An order is accepted when confirmation is provided through the Services or another designated communication method.

5.4 Customers should review their order carefully before submitting it, including items ordered, quantities, special instructions, pickup location, contact information, preferred pickup time, and total amount payable.

5.5 Once an order has entered preparation, changes or cancellations may not be possible.

5.6 Juici Canteen may refuse or cancel an order where an item is unavailable, there is an obvious pricing or system error, the customer has provided insufficient or inaccurate information, payment cannot be successfully processed, there is reasonable suspicion of fraud or misuse, or circumstances beyond our reasonable control prevent fulfilment. Where an order is cancelled by Juici Canteen after payment has been received, the customer will be eligible for a refund of the amount paid for the cancelled order, subject to applicable law.

6. Pickup Orders

6.1 Customers selecting pickup are responsible for collecting their order from the designated Juici Canteen location at or around the selected pickup time.

6.2 The customer may be required to provide an order confirmation, order number or other reasonable verification before the order is released.

6.3 Customers should check their order at the time of pickup and notify a Juici Canteen representative as soon as possible if an item is missing, incorrect or visibly unsatisfactory.

6.4 Once food has been collected and leaves the Juici Canteen premises, WWI cannot ordinarily verify how the food has been stored, handled or transported.

6.5 Accordingly, complaints relating to incorrect, missing or visibly defective food should be raised at the time of pickup or as soon as reasonably practicable thereafter.

6.6 Nothing in this section limits any statutory consumer rights available under the laws of Barbados.

7. Delivery Orders

7.1 Where delivery is offered, orders will be delivered to the address supplied by the customer.

7.2 Customers are responsible for providing a complete and accurate delivery address and contact information.

7.3 Customers should ensure that someone is available to receive the order during the selected delivery period.

7.4 Delivery times are estimates and may be affected by traffic, weather, order volumes, operational issues or other circumstances beyond WWI’s reasonable control.

7.5 If the delivery cannot be completed because the customer cannot be contacted, the delivery address is incorrect or no authorized person is available to receive the order, additional arrangements or charges may apply.

7.6 Where an order cannot be delivered because of an issue caused by WWI or its delivery service provider, WWI will make reasonable efforts to resolve the matter, which may include replacement or refund where appropriate.

8. Cancellation Policy

8.1 Customers may not cancel or amend an order once payment has been submitted.

8.2 Once payment has been submitted, the order may already have entered the preparation or fulfilment process, and food may have been prepared specifically for the customer.

8.3 Customers are therefore encouraged to carefully review all items, quantities, special instructions, pickup or delivery details and the total amount payable before submitting payment.

8.4 Where Juici Canteen cancels an order after payment has been received, any applicable refund will be processed in accordance with Section 10.

8.5 Nothing in this cancellation policy affects a customer’s statutory rights in respect of defective, unsafe, misdescribed or otherwise non-conforming goods or services.

9. Food Quality, Incorrect Orders and Complaints

9.1 Customer satisfaction and food safety are important to Juici Canteen.

9.2 If an order contains a missing or incorrect item, or a food item is damaged, contaminated, unsafe or otherwise materially different from what was ordered, the customer should contact Juici Canteen as soon as possible.

9.3 Customers may be asked to provide order number, date and time of order, description of the issue, photograph of the item or packaging where appropriate, and other information reasonably required to investigate the complaint.

9.4 Depending on the circumstances, Juici Canteen may offer replacement of the affected item, a refund for the affected item, a partial refund, or another appropriate remedy.

9.5 Any remedy offered will be considered in accordance with applicable consumer protection laws.

9.6 Juici Canteen reserves the right to investigate complaints before approving a refund or replacement.

9.7 Nothing in these Terms prevents a customer from exercising rights available under the laws of Barbados.

10. Refunds

10.1 Refunds may be considered where Juici Canteen cancels an order after payment; an ordered product is unavailable and the customer does not accept a substitute; an incorrect item was supplied; an item was missing from the order; a product supplied was defective, unsafe or materially not as described; a duplicate payment was processed; or another circumstance arises in which a refund is required or appropriate under applicable law.

10.2 Refunds will generally be made using the original payment method where reasonably practicable.

10.3 The time required for a refund to appear in the customer’s account may depend on the payment processor or financial institution.

10.4 WWI is not responsible for delays caused solely by a customer’s bank, card issuer, payment processor or other third party.

10.5 Where an order has been correctly prepared and collected by the customer, a refund will not ordinarily be provided solely because the customer subsequently changes their mind or no longer wants the food.

10.6 This provision does not affect statutory rights relating to defective, unsafe, misrepresented or otherwise non-conforming goods.

12. Food Allergies and Dietary Requirements

12.1 Juici Canteen takes reasonable steps to provide accurate information regarding menu items and ingredients.

12.2 Customers with food allergies, intolerances or specific dietary requirements should review the available product information and contact Juici Canteen before placing an order if additional information is required.

12.3 Customers should clearly identify relevant allergies or dietary requirements when the ordering platform provides an opportunity to do so.

12.4 While reasonable precautions may be taken, Juici Canteen operates in an environment where different food products may be prepared and handled. Accordingly, cross-contact with allergens may occur.

12.5 Customers with severe or life-threatening allergies should contact Juici Canteen before ordering to determine whether the requested product can safely be provided.

12.6 Ingredient information may change from time to time. Customers should not rely solely on previous orders or previous menu information.

13. Payment

13.1 Customers may pay using the payment methods made available through the Services.

13.2 Where card or electronic payment is available, payment may be processed by a third-party payment service provider.

13.3 WWI does not intend to store complete payment-card information on its own systems where payment processing is handled by a third-party payment processor.

13.4 Customers must only use payment methods that they are authorized to use.

13.5 WWI reserves the right to delay, reject or cancel transactions where there is reasonable evidence of suspected fraud, unauthorized payment activity or other misuse.

14. Electronic Communications

14.1 By placing an online order, the customer agrees that WWI may use the contact information supplied during checkout to communicate with the customer about the order.

14.2 Order-related communications may include order confirmation, payment confirmation, order status, pickup or delivery updates, requests for clarification, and cancellation or refund information.

14.3 Customers may also receive promotional communications where they have provided the appropriate consent or where otherwise permitted by applicable law.

14.4 Customers may opt out of promotional communications using the unsubscribe mechanism provided in the relevant communication.

15. Customer Information and Privacy

15.1 WWI may collect personal information necessary to process and fulfil orders, communicate with customers, process payments, provide customer support, prevent fraud and meet applicable legal obligations.

15.2 Personal information will be handled in accordance with WWI’s applicable Privacy Policy and the laws of Barbados.

15.3 Customers should not submit unnecessary sensitive personal information through the ordering platform.

15.4 Customers are responsible for ensuring that information supplied when placing an order is accurate and belongs to them or is provided with appropriate authority.

16. Promotions, Discounts and Special Offers

16.1 Promotional offers may be subject to specific terms and conditions.

16.2 Unless otherwise stated, promotions cannot be combined with other offers.

16.3 Promotions may be subject to availability, time limits, quantity limits or other restrictions.

16.4 Juici Canteen will clearly communicate material conditions applicable to promotional offers.

16.5 WWI reserves the right to withdraw a promotion where required due to circumstances beyond its reasonable control or where the promotion has been affected by an obvious technical or pricing error.

17. Intellectual Property

17.1 All trademarks, logos, photographs, graphics, menu designs, text, software and other content displayed through the Services are owned by or licensed to WWI or its relevant licensors unless otherwise stated.

17.2 Customers may use the Services and associated content for personal, non-commercial purposes.

17.3 Customers must not copy, reproduce, modify, distribute, sell or commercially exploit Juici Canteen content without prior written permission.

18. Prohibited Activities

Customers must not use the Services to commit or facilitate fraud; impersonate another person; provide false or misleading information; attempt to gain unauthorized access to WWI systems; introduce malicious software; interfere with the operation of the Services; scrape, harvest or unlawfully collect information; abuse promotional offers or ordering systems; use another person’s account or payment information without authorization; or engage in any activity that violates the laws of Barbados. WWI reserves the right to take appropriate action where misuse of the Services is identified.

19. Third-Party Services

19.1 The Services may use third-party providers for functions including payment processing, delivery, communications, hosting, analytics and other technical services.

19.2 Where a third-party service is used, the customer’s interaction with that provider may also be subject to the provider’s applicable terms and privacy policy.

19.3 WWI will remain responsible for its obligations to customers under applicable Barbados law.

20. Service Availability

20.1 WWI will make reasonable efforts to maintain the availability and functionality of the Services.

20.2 However, online ordering may occasionally be unavailable due to maintenance, technical problems, telecommunications failures, power outages, internet disruptions or other circumstances beyond WWI’s reasonable control.

20.3 WWI does not guarantee uninterrupted or error-free operation of the Services.

20.4 Where an online transaction fails but payment appears to have been processed, customers should contact WWI so that the transaction can be investigated.

21. Limitation of Liability

21.1 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Barbados.

21.2 Subject to applicable law, WWI will not be responsible for loss arising solely from circumstances outside its reasonable control, including telecommunications failures, payment-processing failures, internet disruptions, severe weather, natural disasters or other events beyond its reasonable control.

21.3 Nothing in these Terms limits a customer’s statutory rights in relation to defective, unsafe, misrepresented or otherwise non-conforming products.

22. Governing Law

22.1 These Terms are governed by the laws of Barbados.

22.2 Any dispute concerning the Services will be subject to the applicable laws and jurisdiction of Barbados.

22.3 Customers retain any rights to make complaints or seek remedies through the appropriate consumer protection or legal mechanisms available in Barbados.

23. Customer Complaints and Contact

Customers who have a question, complaint or concern regarding an order should contact Juici Canteen as soon as reasonably possible.

24. Acceptance of Terms

By using the Juici Canteen Services or completing an online order, you acknowledge that you have had an opportunity to review these Terms and agree to be bound by them, subject always to your rights under the applicable laws of Barbados.

Western Wholesale Inc. reserves all rights not expressly granted under these Terms.
